The 'Content Creator Rules' (hereinafter referred to as 'these rules') are a valid agreement between Bmiss and its affiliates (hereinafter referred to as 'Bmiss Community' or 'we') and you (also referred to as 'user' or 'content creator') regarding the platform technology services (hereinafter referred to as 'the services') provided for your creation and operation of a specific online activity community (hereinafter referred to as 'Community'). Please read carefully.
Special Statement:
You fully understand and agree that your effective registration of a Bmiss account and adherence to Bmiss's displayed and periodically updated ''User Service Terms' 'and other agreements and service guidelines (including but not limited to various Bmiss platform service rules, service descriptions, and usage help, collectively referred to as 'Service Rules') are essential prerequisites for enjoying corresponding Bmiss services. The aforementioned agreements and service rules are integral parts of these rules, inseparable and equally legally binding, and you should read, understand, and accept them together.
You agree to these rules and other regulations in ways including but not limited to:
(1) By clicking 'I Agree' or accepting in another manner;
(2) If there are 'implied consent' clauses in this agreement and other rules (including but not limited to service descriptions and usage help), and you click to agree or actually use Bmiss services in any form;
(3) Any other method mutually recognized by you and us.
- Community Name
You understand and commit that the account you create or set up must not violate local laws or regulations of your current country. Your account name, avatar, profile, and other personal information must not contain illegal or inappropriate content. You may not open a Community in someone else's name without their permission (including but not limited to impersonating others' names, avatars, or any other means that may cause confusion).
- Code of Conduct for Community Content Creators
2.1 Content Standards
2.1.1 The information content referred to in these rules refers to any content created, reproduced, published, or disseminated by Community content creators and members within the Community while using Bmiss services. This includes but is not limited to Bmiss account avatars, nicknames, Community descriptions, and all content shared and communicated within the Community in various formats such as web pages, text, images, audio, video, charts, and electronic documents published, transmitted, or disseminated within the Bmiss platform.
2.1.2 Community content creators agree and commit to assume responsibility for the quality and legality of the content they publish within the Community, ensuring guarantees to users and Bmiss. If a content creator violates these rules and their commitments to users, resulting in losses to users or Bmiss (including but not limited to any compensation, reimbursement, fines, etc.), the content creator shall be fully liable for compensating users or Bmiss for all direct or indirect losses incurred.
2.1.3 Content creators shall ensure that they hold complete and valid intellectual property rights for the content they create, reproduce, publish, or disseminate, or have obtained complete, legal, and valid authorization for such rights. Content creators understand and agree that to maintain a civilized, healthy, and harmonious Community ecosystem, they must comply with the following regulations during the process of creating, reproducing, publishing, and disseminating information content. Furthermore, content creators shall be responsible for supervising the behavior of Community members in creating, reproducing, publishing, and disseminating content within the scope of their created Communitys to ensure compliance with these regulations:
2.1.4 Community content creators shall be solely responsible for the legal implications of their publication of any information. Any information that the creator does not wish to be known by other third parties should not be published on Bmiss.
(1) You must not use this platform to create, upload, reproduce, publish, disseminate, or retransmit the following content:
Content that opposes the fundamental principles established by the state;
Content that harms national unity, sovereignty, and territorial integrity;
Content that promotes terrorism or extremism;
Content that leaks state secrets, endangers national security, or damages national honor and interests;
Content that incites ethnic hatred, discrimination, undermines national unity, or infringes on ethnic customs and habits;
Content that promotes cults or feudal superstition;
Content that spreads rumors, disrupts social order, or undermines social stability;
Content that publishes or disseminates obscene, pornographic, gambling, violent, murderous, terroristic, or criminal incitement material;
Content that insults or defames others, infringing on their legitimate rights and interests;
Content that harms social morals or cultural traditions;
Advertisements that do not comply with national laws and regulations, including but not limited to prohibited advertisements and those requiring prior review by relevant authorities;
Content related to prohibited financial information;
Other content that adversely affects the online ecosystem.
Content prohibited by other laws, administrative regulations, and national provisions.
(2) It is prohibited to publish any content that is suspected of infringing rights or likely to offend the public, including but not limited to:
Any malicious defamation of Bmiss, Bmiss users, or other third parties;
Misleading content regarding the source, including impersonating Bmiss staff or using the names of other units, organizations, or individuals;
Any unverified content that may mislead the public;
Any content involving personal privacy or unauthorized personal information;
Any content suspected of infringing on others' rights to reputation, portrait, copyright, trademark, and other legitimate interests;
Content that coerces, induces, or employs other users to subscribe to Communitys, ask questions, express appreciation, like, click on links, or share information;
Content that may lead minors to imitate unsafe behaviors, violate social morals, or develop bad habits;
Any other content that Bmiss deems inappropriate for display on the platform.
(3) It is prohibited to publish content that does not comply with Bmiss's management rules, including but not limited to:
Frequently posting duplicate content or maliciously flooding using special characters, symbols, etc.;
Any form of 'spam' content, including but not limited to advertisements, promotional information for other websites and events, and links to other sites or affiliate codes;
Maliciously failing to fully comply with service agreements made with Community members or providing false service content to defraud funds;
Impersonating Bmiss staff or others to provide services to Community members or other users;
Using technical means to create false accounts in bulk;
Using Bmiss accounts to publish illegal or inappropriate information or engage in other illegal activities;
Other violations of laws and regulations that infringe upon the legitimate rights and interests of Bmiss, Community partners, and Community members.
2.2 Bmiss Content Usage Standards
2.1.1 Community content creators commit that if they are individuals, they are persons with full civil capacity, and they guarantee to provide services to members in accordance with the service content and quality promised in the Community description or by other means. They have the right and ability to continuously fulfill their promised service content and obligations to members, and such actions do not violate any restrictions imposed by binding legal documents.
2.1.2 Content creators commit not to use Bmiss's services to engage in any activities that violate laws and regulations, disrupt the normal operation of Bmiss, infringe upon the legitimate rights of other users, or any other third parties, including but not limited to using Bmiss Community features for activities such as money laundering, gambling, etc.
2.1.3 Content creators commit that the Communitys they establish or operate must comply with the requirements of laws and regulations as well as the relevant rules of the Bmiss platform. They shall not create or operate Communitys containing illegal content, obscenity, infringement of personal information/privacy, infringement of intellectual property rights, or any other content that endangers national security, public interest, or the legitimate rights and interests of any third party.
2.1.4 Without Bmiss's permission, no user or third party may independently or authorize, allow, or assist any other party in the following actions concerning the information content within the 'Bmiss' software and related services:
(1) Copying, reading, or using the information content of the 'Bmiss' software and related services for commercial purposes, including but not limited to promotion, increasing readership, and views;
(2) Unauthorized editing, organizing, or rearranging the information content of the 'Bmiss' software and related services and displaying it through Communitys outside of the original pages of the 'Bmiss' software and related services;
(3) Using any form of identification methods, including but not limited to special symbols or codes, to independently or assist third parties in generating traffic, guiding readership, transferring, or hijacking the information content of the 'Bmiss' software and related services in a detrimental manner;
(4) Any other illegal acts of obtaining or using the information content of the 'Bmiss' software and related services.
2.2.5 Without Bmiss's permission, no user or third party may, by any means (including but not limited to hotlinking, redundant theft, illegal scraping, simulated downloading, deep linking, impersonating registration, etc.), directly or indirectly steal the text, images, videos, or other information content of the 'Bmiss' software and related services, or delete or alter the relevant information content in any manner (including but not limited to hiding or modifying Community IDs, content creator signatures, etc.).
2.3 Regulatory Responsibilities of Community Content Creators
As the creators and operators of the Community, content creators shall bear regulatory responsibilities for the activities of their invited partners and Community members. They must establish Community rules, including but not limited to activity guidelines, to ensure that the activities of the content creator, Community partners, and Community members comply with current laws and regulations, the Bmiss user agreement, and relevant service guidelines. However, the activity guidelines established by the content creator must not infringe upon the legitimate rights and interests of Community partners and members, including personal and property rights, and must not violate existing laws, normative documents, or Bmiss platform rules.
- Intellectual Property and Related Rights
We respect and encourage you and users within the Community to create content. We recognize the importance of protecting intellectual property for the survival and development of the Community and commit to making the protection of intellectual property one of the fundamental principles of Bmiss Community operations.
3.1 All original content (such as answers, articles, ideas, and comments) published by you and your partners on the Community platform is owned by the individual who published it. You may authorize third parties to use it in any manner without needing Bmiss's consent.
3.2 The AI, logos, layout design, typography, text, images, graphics, and other elements included in the network services provided by the Community are protected by copyright, trademark rights, and other laws. The related rights belong to the Community. Without the Community's consent, the aforementioned content may not be directly or indirectly published, used, rewritten, or republished for any purpose, nor used for any other commercial purposes.
3.3 Any third party that republishes content posted within the Bmiss Community outside of Bmiss, whether for commercial or non-commercial purposes, must contact the original author for separate authorization and clearly state the author's name (or the account name used by the author on the Community) and the original link at a prominent position at the beginning of the work, indicating 'Published on Bmiss Community.'
3.4 For any content uploaded or published within the Bmiss Community, you must ensure that you are the copyright holder or have obtained legal authorization, and that such content does not infringe upon any third party's legitimate rights. Otherwise, you shall bear all relevant legal responsibilities independently. If the content is complained about for infringing others' legitimate rights and causes losses to the Community or any third party, you shall be fully liable for the compensation for those losses.
3.5 Bmiss's services utilize E2EE (end-to-end encryption) privacy design, which means that Bmiss cannot analyze or monitor the content created and stored on the Bmiss application platform or shared with other users. Therefore, Bmiss has no obligation to review content posted by users; all users shall bear full legal responsibility for their posting behavior regarding any information.
- Protection of Minors
4.1 If you are under the age of majority as defined by applicable law (generally 18 years old, but this may vary by country or region), you should read this agreement under the supervision and guidance of a guardian before using the products or services of this software, and use the software's products or services only after obtaining your guardian's consent. You and your guardian are responsible according to applicable laws and this agreement. If you are a guardian of a minor user, please read carefully and decide whether to agree to this agreement.
4.2 Bmiss places great importance on the protection of minors. To better protect the privacy rights of minors, we remind you to strictly comply with the ''Bmiss Minor Content Management Standards' 'and to be cautious when publishing content that includes materials related to minors.
- Disclaimer
5.1 Bmiss cannot guarantee the accuracy of the content, comments, or answers posted by users.
5.2 The content published by users on the Bmiss platform reflects their personal positions and views, and does not represent the stance or views of Bmiss. As the publisher of the content, users are solely responsible for what they publish, and any disputes arising from the published content shall be fully borne by the publisher. Bmiss does not assume any responsibility (including joint liability).
5.3 Bmiss does not guarantee that the network services will meet user requirements, nor does it guarantee that the network services will not be interrupted. Bmiss cannot ensure the timeliness, security, or accuracy of the network services.
5.4 Bmiss is not responsible for any interruptions or other defects in network services caused by force majeure or reasons beyond its control, but will make every effort to minimize any losses and impacts caused to users.
- Miscellaneous
6.1 To provide better services or due to changes in laws, regulations, policies, technical conditions, product features, etc., the Bmiss team may revise this agreement from time to time. The revisions will become part of this agreement. After the agreement is updated, Bmiss will notify you of the updates through the official website '(www.Bmiss.im) 'or other appropriate means before the updated terms take effect, so that you can stay informed about the latest version of this agreement.
6.2 If you disagree with the modified terms of the agreement, please stop using the Bmiss software and related services immediately. Continuing to use the Bmiss software and related services will be regarded as your acceptance of the modified terms.
6.3 In light of Bmiss's decentralized nature, the signing, effectiveness, performance, interpretation, and dispute resolution of this agreement will, as much as possible, not rely on the laws of any specific country or region. Bmiss advocates for community autonomy and encourages resolving potential disputes and disagreements through decentralized governance mechanisms. If it becomes necessary to resort to legal avenues due to special circumstances, you and the Bmiss team should negotiate amicably. If negotiations fail, both parties may choose the laws and jurisdictions applicable in their respective countries or regions, but only for resolving that specific dispute.
6.4 The headings of all terms in this agreement are for convenience of reading only and have no actual meaning. They cannot be used as a basis for interpreting the meaning of this agreement.
6.5 If any part of the terms of this agreement is found to be invalid or unenforceable for any reason, the remaining terms shall remain valid and binding on both parties.
